What to do if confronted by ICE

If you or family members are confronted by an DHS ICE officer, politely state that you wish to remain silent, ask to speak to a lawyer, and do not answer any questions about your immigration status or provide any documentation without an attorney present. You have the right to remain silent and should not provide any information that could be used against you in immigration proceedings.

  • Right to remain silent:

This is your most important right; exercise it by stating clearly that you want to speak to a lawyer before answering any questions.

  • Do not consent to searches:

Unless they have a valid judicial warrant signed by a judge, you can refuse to allow ICE agents to search your home or belongings.

  • Ask to see identification:

Verify the officer’s identity and badge before engaging in any conversation.

  • Do not lie or provide false documents:

Providing false information can worsen your legal situation.

  • Do not sign any documents given to you by an ICE agent without talking to a lawyer:

Always consult with a lawyer before signing any papers related to your immigration status.

If you are arrested by ICE:

  • Do not resist arrest or try to run from ICE.
  • Inform the arresting ICE officer that you want to speak to a lawyer and will not answer questions without one.
  • Fight your deportation in immigration court. If you do not get the chance to talk to an attorney right away, and ICE is processing you for removal, tell the ICE officer you want to fight your case in immigration court.
  • If you can’t reach a lawyer right away, contact your family members and let them know that you are being detained by ICE and the location where you are being detained. If you are given an A number, give this number to your family member as well.
  • Do not sign any documents given to you by an ICE agent without talking to a lawyer.
